The Hills' Jason Wahler in Rehab

The Hills star Jason Wahler is in rehab, a family member tells PEOPLE exclusively.

"Jason's in rehab, and he's getting help," said the relative, who declined to give her name.

"He's doing well, and he's going to be a new man," she added. "There was a deal made [with prosecutors]."

Wahler, 20, was due to surrender to Los Angeles County jail last week to serve a 60-day sentence for a September 2006 assault case, but a judge delayed that in lieu of rehab.

"His jail sentence has been suspended for now," says L.A. City Attorney spokesman Frank Mateljan. "But we'll be informing the court of Wahler's latest arrest in Seattle at his next progress report hearing on June 8."

Wahler, who had been on 36 months' probation since March, may be in even more trouble if Seattle city attorneys file formal assault and trespassing charges, stemming from his arrest at a Seattle hotel on April 8.

If convicted in that case, Wahler could be found in violation of probation in L.A., which could result in even more jail time.

In March, Wahler was arrested in Greenville, N.C., on charges of underage drinking and resisting a public officer during a raid at a local nightclub.

Earlier this year, he was also found guilty of resisting arrest and bribery stemming from an arrest in New York last September.

A rep for Wahler did not return calls for comment.
